Terms of Service
1. The Service
TasteLabs provides tools to discover and share recipes, scan ingredients, generate recipe ideas using artificial intelligence where enabled (currently via OpenAI, LLC’s API services), track optional health-related information you choose to enter, and interact with other users. Features may change over time. Some features require an account; limited use may be available as a guest where offered.
2. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be old enough to enter a binding contract where you live (typically at least 13, or higher if required in your region). We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.
3. Subscriptions and payments
Paid plans, if offered, will be presented in the app or through official app stores. Prices and billing terms shown at purchase apply. Until in-app purchase is fully integrated, subscription features described in the app may be marked as coming soon. Refunds follow the policies of the payment provider (e.g. Apple App Store or Google Play) where applicable.
4. User content
You retain rights to content you submit (e.g. recipes, photos, profile information). You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content solely to operate, improve, and promote the Service. You represent that you have the rights to grant this license. Do not upload unlawful, infringing, or harmful content.
5. AI-generated content
Features that use artificial intelligence (provided through OpenAI’s hosted models when you trigger AI flows) may produce inaccurate, incomplete, or unsafe suggestions (including recipes and nutrition-related outputs). AI output is informational only and is not professional dietary, medical, or safety advice. Always verify ingredients, allergens, cooking steps, and food safety before consuming or serving food. OpenAI’s terms and policies may apply to your use of those features in addition to ours.
6. Acceptable use
You agree not to: misuse or attempt to break the Service; scrape or overload our systems; harass users; upload malware; impersonate others; violate applicable law; or attempt to access data or accounts without permission. We may investigate and cooperate with law enforcement for violations.
7. Intellectual property
The Service, branding, and original materials we provide are owned by TasteLabs or our licensors and are protected by intellectual property laws. Except for your own content or as expressly permitted, you may not copy, modify, or distribute our proprietary materials without prior written consent.
8. Third-party services
The Service may integrate third parties (e.g. authentication, cloud hosting, and OpenAI for generative AI and vision-related inference). Their terms and privacy practices may also apply. We are not responsible for third-party services outside our reasonable control.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TASTELABS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW.
11. Indemnity
You will defend, indemnify, and hold harmless TasteLabs from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or operational reasons. Provisions that by their nature should survive (e.g. disclaimers, limitations, indemnity) will survive termination.
13. Changes
We may update these Terms from time to time. We will post the updated version in the app and may update the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.
14. Governing law
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless a different governing law is required by the consumer protection rules of your place of residence.
15. Related policies
Additional policies that form part of your agreement with us or describe our practices are available in the app under Settings → Legal, including: Community Guidelines; Cookie & Similar Technologies Policy; Subscription & Billing Policy; Subprocessor disclosure; Health Data Supplement (if you use health-related features); and Open Source / Third-Party Notices. If any conflict arises between these Terms and a policy, these Terms control unless the other policy expressly states otherwise for a specific topic.
